These Terms of Service (“Terms”) form a binding agreement between you and gAInXalpha (operated from 19 Queen Elizabeth Street, London, Southwark, SE1 2LP, United Kingdom; “we”, “us”, “our”). By creating an account, subscribing to a plan, or otherwise using gainxalpha.com (the “Service”) you confirm that you have read, understood, and accepted these Terms together with our Privacy Policy.
1. What the Service does
gAInXalpha operates a proprietary predictive engine that combines public market data and licensed news feeds with statistical and machine-learning models to produce forward-looking signals on individual stocks and market sectors. The Service automatically publishes daily articles summarising those signals, lets subscribers build watchlists, and offers deep-dive reports across configurable time horizons (typically 2-week, 1-month, and 3-month outlooks).
The Service is an information and education tool, not a regulated financial advisory service. Section 6 below sets out the disclaimer in full.
2. Eligibility & accounts
- You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction.
- You agree to provide accurate, current, and complete information at registration and to keep it up to date.
- You are responsible for safeguarding your password and for any activity carried out under your account. Notify us immediately of any unauthorised access at support@gainxalpha.com.
- One account per person. Sharing credentials, automated scraping of premium content, or resale of any output is prohibited.
3. Subscription plans, billing & free trial
- Free Guest — perpetual free tier with limited access to public articles and the daily market snapshot.
- Advisor — €29 per month. Includes the full daily report, multi-horizon engine forecasts, watchlists, and deep-dive reports.
- Institutional — custom pricing for teams and corporate use. Contact sales.
New Advisor subscribers may be offered a 1-week free trial. No payment is taken during the trial, but a valid payment method must be on file. The trial converts automatically to a paid subscription at the end of the trial period unless cancelled. Subscriptions then renew on a monthly cycle until cancelled.
Payments are processed by Stripe Payments Europe, Ltd.. Card data is collected and held inside Stripe’s PCI-DSS environment; we never see or store full card numbers. Recurring renewals are charged automatically on the same day of each billing cycle.
4. Cancellation & refunds
- Cancel anytime. You can stop your subscription from your Account dashboard. Cancellation takes effect at the end of the current paid period. You keep access until then and are not charged again.
- EU/UK statutory right of withdrawal. Consumers in the EU and UK have 14 days from the start of a paid subscription to withdraw and receive a full refund — provided you have not yet consumed substantive premium content during that period. By accepting the free trial or by viewing premium content within the 14-day window you expressly request immediate performance of the Service and accept that you lose your right of withdrawal once premium content has been accessed.
- Outside that window, monthly subscription fees are non-refundable. We may offer a pro-rata or goodwill refund at our sole discretion in exceptional cases — contact support@gainxalpha.com.
- Failed payments. If a renewal payment fails, we retry for up to 7 days. Continued failure results in suspension of premium access; we do not assess late fees.
5. AI-generated content & data sources
Articles, summaries, and forecasts on the Service are produced by an automated AI pipeline. They may contain inaccuracies, omit relevant context, or reach conclusions a human analyst would not. We curate and quality-check the pipeline but do not guarantee the accuracy, completeness, or timeliness of any output. Data sources include public exchanges, licensed news APIs, fundamentals databases, and third-party AI models. Trademarks of underlying instruments and indices belong to their respective owners.
6. Not financial advice
Nothing on the Service is intended to be, and you must not treat it as, financial advice, investment advice, tax advice, legal advice, a personal recommendation, or a solicitation to buy or sell any security or financial instrument. We do not know your financial situation, objectives, or risk tolerance, and the Service has not been authorised by the UK Financial Conduct Authority or any other regulator. Past performance is not indicative of future results. Trading and investing involve significant risk of loss, up to and including the full amount invested. Always consult a properly qualified, independent financial professional before making any financial decision.
7. Acceptable use
You agree not to:
- Scrape, mirror, or systematically download premium content, or republish it in any commercial product.
- Use the Service to develop a competing predictive engine, ranking system, or signal feed.
- Reverse-engineer, decompile, or attempt to extract our model weights, prompts, or proprietary signals.
- Bypass paywalls, share access credentials, or use multiple accounts to evade plan limits.
- Use the Service to violate applicable law, infringe intellectual property, or transmit malicious code.
- Interfere with the integrity, security, or availability of the Service or attempt to gain unauthorised access.
We may suspend or terminate access (with refund of unused paid time, where applicable) if we reasonably believe these rules are being broken.
8. Intellectual property
All software, models, prompts, datasets, branding, copy, design, and other materials on the Service are owned by gAInXalpha or its licensors and are protected by copyright, database, trade-mark, and other intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to access and view the Service for your own non-commercial use only. All rights not expressly granted are reserved.
9. Third-party links
The Service may contain links to third-party websites, data feeds, or services. We do not control and are not responsible for the content, policies, or practices of those parties. Following a link is at your own risk.
10. Limitation of liability
To the maximum extent permitted by law:
- The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading losses arising out of or in connection with your use of the Service or reliance on its output.
- Our total aggregate liability for any direct loss arising under or in connection with these Terms is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) €100.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited by applicable law.
11. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) brought by a third party arising out of your use of the Service in breach of these Terms or in violation of applicable law.
12. Account termination
You may delete your account at any time from the Account dashboard or by emailing support. We may suspend or terminate the Service, in whole or in part, for material breach of these Terms, suspected fraud, regulatory necessity, or if the Service is wound down. Where termination is not for cause, we will refund the unused pro-rata portion of any paid subscription period.
13. Changes to the Terms
We may amend these Terms from time to time. Substantive changes will be notified by email and a banner on the site at least 30 days before they take effect. If you do not accept the change, you may cancel before it takes effect and we will refund any unused, pre-paid portion.
14. Governing law & disputes
These Terms are governed by the laws of England and Wales. Subject to applicable consumer-protection rules that may give you the right to bring proceedings in your country of residence, you and we agree that the courts of England and Wales have exclusive jurisdiction over any dispute arising under these Terms. Before commencing legal proceedings, we encourage you to contact support@gainxalpha.com so we can attempt to resolve the issue informally.
